Terms of use

These terms govern your use of this website. They are not your agreement with us for the WynkPay platform itself — that agreement is presented to you inside the app when you open an account, and it is the document that governs your wallet, your merchant account and any credit facility.

1. Who we are

WynkPay (Pty) Ltd, registration number 2016/409836/07, a company incorporated in the Republic of South Africa with its registered address at PO Box 0000, Johannesburg, 2000, South Africa.

WynkPay is an authorised financial services provider, FSP 00000, regulated by the Financial Sector Conduct Authority. WynkPay is not a bank and is not registered as a deposit-taking institution under the Banks Act 94 of 1990. Funds you hold in a WynkPay wallet are held in trust at our sponsor bank, a registered South African bank, and are not used to fund our lending or our operations.

Credit products — merchant cash advances, stock on credit, buy-now-pay-later arrangements, overdraft facilities and personal loans — are offered under registration with the National Credit Regulator, NCRCP17266, and are subject to the National Credit Act 34 of 2005, including its affordability assessment requirements. Approval is never automatic and qualifying criteria apply.

2. What this site is

This site describes the WynkPay platform and lets you begin an application. Nothing on it is an offer capable of acceptance, a quote, or advice. In particular, nothing on this site is financial advice as contemplated by the Financial Advisory and Intermediary Services Act 37 of 2002. We do not know your circumstances and we are not advising you to take any product.

Fees, limits, hardware specifications and product descriptions published here are the standard published position at the effective date shown. They may change. Where they differ from a signed agreement between you and WynkPay, that agreement governs.

3. Applying through this site

When you submit your cellphone number through the sign-up form you are asking us to start an application, not opening an account. We will send a one-time PIN to the number you give us and, if you continue, we will ask for the verification documents that the Financial Intelligence Centre Act 38 of 2001 requires before an account can be opened.

  • You must be at least 18 years old and legally able to contract.
  • You must give us a number you control. Submitting somebody else's number without their consent is a misuse of this site and of their personal information.
  • We rate-limit sign-up submissions and may decline to process an application without giving reasons, subject to our obligations under the Promotion of Administrative Justice Act 3 of 2000 where those apply.

4. Acceptable use

Do not attempt to gain unauthorised access to this site or to any system connected to it, do not scrape it at a rate that degrades it for other people, and do not use it to transmit anything unlawful. We log requests for security and abuse-prevention purposes as described in our POPIA notice.

5. Intellectual property

The WynkPay name, logo, wordmark and the design of this site are owned by WynkPay (Pty) Ltd. You may quote and link to this site with attribution. You may not use our marks in a way that suggests endorsement or affiliation without our written permission.

6. Third parties

The platform relies on third parties — a sponsor bank, payment schemes, value-added service aggregators, credit bureaux, courier partners and hardware vendors. Where we name them, we do so descriptively. Naming a partner is not a statement about the commercial terms between us and them, and it does not make them a party to your agreement with us.

7. Availability and liability

We do not warrant that this site will be uninterrupted or error-free. To the maximum extent permitted by law, and subject always to the Consumer Protection Act 68 of 2008 where it applies to you, we are not liable for indirect or consequential loss arising from your use of this website. Nothing in these terms limits liability that cannot lawfully be limited.

8. Complaints and disputes

Raise a complaint with us first, at help@wynk.cash. If we cannot resolve it, you may approach the FAIS Ombud for financial advisory complaints, the National Financial Ombud Scheme for banking and credit complaints, or the National Credit Regulator in respect of a credit agreement. Where the complaint concerns personal information, you may complain to the Information Regulator as set out in our POPIA notice.

9. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

10. Electronic communications

This site and our communications with you are electronic communications in terms of the Electronic Communications and Transactions Act 25 of 2002. Our address for legal service and the disclosures required by section 43 of that Act are set out above and in the site footer.
